释义	法律分析: 商标权的宣告无效是指已经注册的商标，违反商标法第十条、第十一条、第十二条规定的，或者是以欺骗手段或者其他不正当手段取得注册的，由商标局宣告该注册商标无效；其他单位或者个人可以请求商标评审委员会宣告该注册商标无效的制度。法律依据: 《中华人民共和国商标法》第四十六条法定期限届满，当事人对商标局宣告注册商标无效的决定不申请复审或者对商标评审委员会的复审决定、维持注册商标或者宣告注册商标无效的裁定不向人民法院起诉的，商标局的决定或者商标评审委员会的复审决定、裁定生效。
