释义	法律分析：遗弃罪是指负有扶养义务的人，对年老、年幼、患病或者其他没有独立生活能力的人拒绝扶养，情节恶劣的行为。夫妻一方不抚养孩子构不构成遗弃罪，还要看遗弃行为有没有造成情节恶劣的后果，如有则可构成遗弃罪，没有则不会构成，不能仅从夫或妻一方有将孩子抛弃的行为就认为对方构成遗弃罪。法律依据：《刑法》第二百六十一条规定，对于年老、年幼、患病或者其他没有独立生活能力的人，负有扶养义务而拒绝扶养，情节恶劣的，处五年以下有期徒刑、拘役或者管制。
