释义	法律分析：为了保护招标人的利益，我国的招标法规定，投标人应缴纳不超过投标总价的百分之二的保证金。也是为了约束投标人的投标行为。法律依据：《政府采购货物和服务招标投标管理办法》第三十六条规定：招标采购单位规定的投标保证金数额，不得超过采购项目概算的1%。工程施工、货物采购类：投标保证金一般不超过投标报价的2%，最高不得超过80万元人民币。
