释义	代扣分是违法的。一旦发现代替他人扣分并谋取利益的情况，将被暂扣驾驶证6个月，并处1000到2000元罚款。违章不能用别人的驾照扣分，买卖驾照分是违法行为，不管买分还是卖分，一旦发现，都将处5到10日行政拘留，并处200元以上500元以下罚款。法律依据：《中华人民共和国治安管理处罚法》第六十条伪造、隐匿、毁灭证据或者提供虚假证言、谎报案情，影响行政执法机关依法办案的，将处5日以上10日以下拘留，并处200元以上500元以下罚款。
