释义	法律分析：我国的刑法并没有对婚外恋作出明确的规定。一般情况下，小三跟有配偶的男方同居的这种行为不会触犯法律，因此也没有犯法，不会判刑，更不会坐牢。婚外情的双方只会受到来自社会的道德谴责和约束，男方婚外情的这种行为可以作出夫妻关系确实已破裂的证据。只有该婚外恋行为构成重婚罪时，才可以判刑。法律依据：《中华人民共和国刑法》第二百五十八条重婚罪指有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
