问题	开荒土地使用权纠纷解决办法有哪些
释义	根据《土地管理法》第四十条、第七十四条和《农村土地承包法》第二十八条规定，对经依法批准和村集体经济组织同意，签订了家庭土地承包合同的农户新开垦土地，应按原土地承包关系进行确权登记颁证。对开荒地的使用权有争议，应当由村民(代表)会议决定如何处理，如果要收回开荒者的土地使用权，应当对开荒者作出适当补偿。可以向当地农村土地承包仲裁机构申请仲裁，也可以直接向法院起诉。自接到处理决定通知之日起三十日内，向人民法院起诉。在土地所有权和使用权争议解决前，任何一方不得改变。
