释义	法律分析：委托代理人与当事人之间的一种特殊委托诉讼代理，委托人先不预支付代理费，案件执行后委托人按照执行到位债权的一定比例付给代理人作为报酬。如果败诉或者执行不能，代理人将得不到任何回报；如果债权一旦执行到位，被代理人将按照约定的高额比例支付给代理人，对双方来讲都存在一定风险，所以称之为风险代理。法律依据：《律师服务收费管理办法》第十三条实行风险代理收费，律师事务所应当与委托人签订风险代理收费合同，约定双方应承担的风险责任、收费方式、收费数额或比例。
