释义	公平原则是平等原则的对立物，民法以追求形式平等为原则，以追求实质平等为例外；当遵循平等原则会产生严重的是指不公平时，在法定的例外情形，适用公平原则予以纠偏，合理确定民事主体的权利义务，以免造成对实质公平的过度违反，公平原则只能适用于法定的例外情形。《民法典》第六条民事主体从事民事活动，应当遵循公平原则，合理确定各方的权利和义务。
