2023年商标的归属权是怎样的

商标的归属权就是指商标的权利人，商标权利人是指享有商标的：使用权、独占权、许可使用权、设立抵押权、转让权、继承权、投资权、禁止权的个人或单位。商标权利人一般就是商标申请人或者商标被授权使用人。所以商标的归属是享有商标权利的个人或者单位。
法律依据：
《中华人民共和国商标法实施条例》 第四十七条 注册商标的注册人死亡或终止一年以上，未向商标局申请办理移转手续的，任何人可以向商标局申请注销该注册商标。
