释义	依据我国相关法律的规定，给钱但没有发生性关系的，一般不认定为嫖娼，但如果能证明当事人有主观嫖娼意志，未发生性关系也可以认定为嫖娼。法律依据：《中华人民共和国治安管理处罚法》第六十六条卖淫、嫖娼的，处10日以上15日以下拘留，可以并处5000元以下罚款；情节较轻的，处5日以下拘留或者500元以下罚款。在公共场所拉客招嫖的，处5日以下拘留或者500元以下罚款。
