释义	法律分析：拘役，是指短期剥夺罪犯人身自由，就近拘禁并强制劳动的刑罚。在中国是主刑之一，拘役的期限为1个月以上6个月以下，数罪并罚时最高不能超过1年。《刑法》第四十三条规定，被判处拘役的犯罪分子，由公安机关就近执行。法律依据：《中华人民共和国刑法》第三十八条管制的期限，为三个月以上二年以下。判处管制，可以根据犯罪情况，同时禁止犯罪分子在执行期间从事特定活动，进入特定区域、场所，接触特定的人。对判处管制的犯罪分子，依法实行社区矫正。第四十二条拘役的期限，为一个月以上六个月以下。
