释义	法律分析：用工关系是指劳动者与用工者根据约定，由劳动者向用工者提供一次性的或者是特定的劳动服务，用工者依约向劳动者支付劳务报酬的法律关系法律依据：《最高人民法院关于审理人身损害赔偿案件适用法律若干问题的解释》第十一条雇员在从事雇佣活动中遭受人身损害，雇主应当承担赔偿责任。由此可见，在劳务关系中，接受劳务的一方对于提供劳务的一方因劳务自己受到损害的，承担的是过错责任。但在雇佣关系中，雇主对雇员因雇佣活动遭受人身损害，要承担无过错责任。
