释义	个人去世后，应当通过继承债务人财产的继承人主张清偿债务。如果在有遗产的情况下，债权人起诉时，遗产未分割的，数个继承人均应列为被告参加诉讼，而放弃继承的除外，如果已经继承的，应以继承的债务人财产的份额内偿还债务，借款人死亡并不影响抵押借贷关系的认定。【法律依据】《民法典》第一千一百六十一条，继承人以所得遗产实际价值为限清偿被继承人依法应当缴纳的税款和债务。超过遗产实际价值部分，继承人自愿偿还的不在此限。继承人放弃继承的，对被继承人依法应当缴纳的税款和债务可以不负清偿责任。
