年满16岁属于童工嘛

孩子16岁上班不算童工。我国法律上规章，未满十六周岁的用工为童工。通过劳动法的规章，孩子16岁上班是属于未成年工；未成年工是年满十六周岁未满十八周岁的劳动者。
法律依据：
《禁止使用童工规章》 第二条 国家机关、社会团体、企业事业单位、民办非企业单位或者个体工商户（以下统称用人单位）均不得招用不满16周岁的未成年人。
