释义	法律分析：诉讼行为能力指的是：当事人可以亲自参与诉讼，行使诉讼权利和承担诉讼义务的诉讼法上的资格。在民事诉讼中，只有具有完全民事行为能力的公民才有诉讼行为能力。无民事行为能力和限制民事行为能力的公民都没有诉讼行为能力。只能通过其法定代理人或者由其法定代理人委托的诉讼代理人代为实施诉讼行为。法律依据：《中华人民共和国民事诉讼法》第五十七条无诉讼行为能力人由他的监护人作为法定代理人代为诉讼。法定代理人之间互相推诿代理责任的，由人民法院指定其中一人代为诉讼。
