问题	刑事拘留可以提前释放吗
释义	如果刑事案件情节较轻不予追究刑事责任，或者证据不足，检察院未批准逮捕等情形会释放嫌疑人。法律依据《公安机关办理刑事案件程序规定》第一百二十二条拘留后，应当立即将被拘留人送看守所羁押，至迟不得超过二十四小时。异地执行拘留的，应当在到达管辖地后二十四小时以内将犯罪嫌疑人送看守所羁押。第一百二十四条对被拘留的人，应当在拘留后二十四小时以内进行讯问。发现不应当拘留的，应当经县级以上公安机关负责人批准，释放通知书，看守所凭释放通知书发给被拘留人释放证明书，将其立即释放。
