释义	看情况。当事人在婚内与别人同居的，如果是以夫妻的名义共同生活的，会形成事实的婚姻关系，是属于重婚罪的行为表现之一，会构成重婚罪。认定重婚罪的主要情形：1、有配偶者又与第三人结婚。2、明知他人有配偶而与之结婚。3、有配偶者与第三人以夫妻名义进行同居。注：并非只有进行两次结婚登记才构成重婚罪。我国法律规定：“有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。” 法律依据《中华人民共和国刑法》第二百五十八条
