保险公司能否理赔 |

理赔程序有以下几个步骤：1.报赔。发生交通事故后，应保护好现场，并及时向保险公司报案，路面事故同时还要报请交通部门处理。2.核定。对第三者责任的索赔，应由保险公司对赔偿金额依法确定，并依据投保金额予以赔付。对于保户与第三者私下谈定的赔偿金额，保险公司可拒绝赔付。3.赔付规定。发生交通事故的保险车辆，车辆损失险和第三者责任险在符合赔偿规定的金额内实行绝对免赔率。即保险人根据事故鉴定结论对被保险人实行部分赔偿。被保险人在事故中负全部责任的免赔20，负主要责任的免赔15，负同等责任的免赔10，负次要责任的免赔5。因此，并非出事故，保险公司就全部赔偿。如此项投保了不计免赔险，即可在任何情况下享受100赔偿。4.赔付时间。自交通事故处理结案之日起3个月内，保户应持保险单、事故处理证明、事故调解书、修理清单及其他有关证件到保险公司领取赔偿金。保险公司支付赔款一般在10天以内。赔款必须在1年内领取，否则将做放弃处理。5.争议。如与保险公司发生争议不能达成协议，可向经济合同仲裁机关申请仲裁或向人民法院提起诉讼。
