机动车驾驶证的有效期分为6年、10年和长期。首次申请是6年，超过有效期的机动车驾驶证则无效，不能再次使用，持有过期驾驶证的机动车驾驶人员不能驾驶机动车，需要重新考取驾驶证才能上路。

    第五十六条
    机动车驾驶人在机动车驾驶证的六年有效期内，每个记分周期均未记满12分的，换发十年有效期的机动车驾驶证；
    在机动车驾驶证的十年有效期内，每个记分周期均未记满12分的，换发长期有效的机动车驾驶证。
