释义	法律分析：甲方一般是指提出目标的一方，在合同拟订过程中主要是提出要实现什么目标，是合同的主导方。乙方一般是劳务方，也就是负责实现目标的主体。在订立合同的时候，双方谁先提出要求的，一般作为甲方；也可以协商。其实甲方、乙方称呼无所谓的，并不表明权利的轻重，双方在法律中没有什么区别，双方都要遵守合同条款。违约方是要承担违约责任的。法律依据：《中华人民共和国劳动合同法》第二十九条用人单位与劳动者应当按照劳动合同的约定，全面履行各自的义务。
