释义	女职工在休产假期间有工资的，对已经参加生育保险的，按照用人单位上年度职工月平均工资的标准由生育保险基金支付；没有参加生育保险的，按照女职工产假前工资的标准由用人单位支付。法律依据：《中华人民共和国社会保险法》第五十六条职工有下列情形之一的，可以按照国家规定享受生育津贴：（一）女职工生育享受产假；（二）享受计划生育手术休假；（三）法律、法规规定的其他情形。生育津贴按照职工所在用人单位上年度职工月平均工资计发。
