释义	法律分析：法律没有规定必须要原公司的离职证明，但是因为一个劳动者同时只能与一家用人单位签订劳动合同，如果同时与两家用人单位签订劳动合同，那么后一家用人单位没有尽到相应审查义务，给其他用人单位造成损失的，有可能要承担连带赔偿责任，所以新公司有可能需要原公司的离职证明，这也是合情合理合法的，但并不是都有这种要求，视具体情况而定。法律依据：《中华人民共和国劳动合同法》第九十一条用人单位招用与其他用人单位尚未解除或者终止劳动合同的劳动者，给其他用人单位造成损失的，应当承担连带赔偿责任。
