释义	法律分析：根据我国法律的相关规定，工伤认定采用的是无过错责任原则，如果因为员工的违规行为导致工伤事故的发生，是不影响员工的工伤赔偿金的。员工的违规行为，可以由单位按照规章制度进行处罚。我国法律规定，有三种情况是不认定为工伤的，如员工自残、员工因为醉酒导致的伤亡等，也就无法得到工伤赔偿。法律依据：《中华人民共和国工伤保险条例》第十六条，职工有下列情形之一的，不得认定为工伤或者视同工伤：（一）因犯罪或者违反治安管理伤亡的；（二）醉酒导致伤亡的；（三）自残或者自杀的。
