法律主观：
社会抚养费 、滞纳金及终止妊娠 保证金 ，必须按非税收入管理要求，实行“收支两条线”管理，收入全额上缴县级国库。县级人口和计划生育行政部门应将上年结转和当年征收的社会抚养费纳入本级部门预算的编制范围。社会抚养费不征收调节基金，县级人民政府不得以社会抚养费收入抵减同级计划生育事业费的正常投入。 切实加强社会抚养费征收票据管理。《湖南省非税收入一般缴款书》、《湖南省非税收入缴款通知单(计划生育专用)》由县级人口和计划生育行政部门到同级财政部门统一购领，并加盖财务专用章后下发执收单位。各执收单位应健全《湖南省非税收入一般缴款书》、《湖南省非税收入缴款通知单(计划生育专用)》领用、保管、缴销、审核等内部管理制度。 乡镇人民政府、街道办事处应将违法生育者征收社会抚养费的个案信息及时录入《湖南省育龄妇女信息系统》，如实反映每个违法生育者社会抚养费征收情况。实行委托征收的乡镇人民政府、街道办事处应当每月向县级人口和计划生育行政部门报告社会抚养费征收情况。 县级人口和计划生育行政部门应分乡镇建立社会抚养费征收、拨付明细账，及时掌握各乡镇社会抚养费上缴、拨付(或使用)情况，并定期与乡镇人民政府、街道办事处核对。
