释义	法律分析：本罪在主观方面是直接故意犯罪。行为须有明知是国有资产而故意违反国家规定，将其集体私分给个人的确定故意。如疏忽大意地误将国有资产当作企业资金加以集体私分者，不能成立本罪，情节严重者，可按有关渎职犯罪处理。法律依据：《中华人民共和国刑事诉讼法》第一百七十二条人民检察院认为犯罪嫌疑人的犯罪事实已经查清，证据确实、充分，依法应当追究刑事责任的，应当作出起诉决定，按照审判管辖的规定，向人民法院提起公诉，并将案卷材料、证据移送人民法院。
