释义	劳动者按规定辞职，并不需要用人单位批准。根据《劳动合同法》第三十七条规定：“劳动者提前三十日以书面形式通知用人单位，可以解除劳动合同。劳动者在试用期内提前三日通知用人单位，可以解除劳动合同。”劳动者按此规定辞职是合法的，时间一到可以离职。不过劳动者要留存好按规定辞职的证据。如果用人单位因此扣发工资，劳动者可向劳动仲裁委申请劳动仲裁（不收费），可以再要回工资。
