释义	我国暂时还没有专门针对网络盗窃制定相应的规定，因此对于网络盗窃的量刑标准与一般盗窃罪的量刑标准是一样的，即：1、个人盗窃公私财物价值人民币1000元至3000以上的，为“数额较大”，处三年以下有期徒刑、拘役或者管制，并处或者单处罚金；2、个人盗窃公私财物价值人民币30000至100000元以上的，为“数额巨大”，处三年以上十年以下有期徒刑，并处罚金；3、个人盗窃公私财物价值人民币300000至500000元以上的，为“数额特别巨大”，处十年以上有期徒刑或者无期徒刑，并处罚金或者没收财产。
