释义	法律分析: 劳动者辞职后，其个人档案是不可以拿走的，劳动者的档案应当由用人单位转送新单位，没有新单位的转送劳动部门下公共就业服务机构或者设区劳动保障所。法律依据: 《企业职工档案管理工作规定》第十八条企业职工调动、辞职、解除劳动合同或被开除、辞退等，应由职工所在单位在一个月内将其档案转交其新的工作单位或其户口所在地的街道劳动（组织人事）部门。职工被劳教、劳改，原所在单位今后还准备录用的，其档案由原所在单位保管。
