释义	法律分析: 所谓建设工程施工“阴阳合同”是指建设工程施工合同的当事人就同一建设工程签订的两份或两份以上实质性内容相异的合同，通常把经过招投标并经政府有关部门备案的合同称为“阳合同”，把实际履行的对“阳合同”中实质性内容进行了重大变更的合同称为“阴合同”。法律依据: 《中华人民共和国民法典》第一百四十六条行为人与相对人以虚假的意思表示实施的民事法律行为无效。以虚假的意思表示隐藏的民事法律行为的效力，依照有关法律规定处理。
