释义	法律分析：敲诈勒索罪可以通过以下四个要件进行认定：1、侵犯的客体是公私财物的所有权和他人的人身权利或者其他权益；2、在客观方面表现为行为人采用威胁、要挟、恫吓等手段，迫使被害人交出财物的行为；3、主体为一般主体；4、在主观方面表现为直接故意。法律依据：《中华人民共和国治安管理处罚法》第四十九条盗窃、诈骗、哄抢、抢夺、敲诈勒索或者故意损毁公私财物的，处五日以上十日以下拘留，可以并处五百元以下罚款；情节较重的，处十日以上十五日以下拘留，可以并处。
