释义	立功认定申请的规定在《刑法》第六十八条，其中规定犯罪分子有立功表现的，可以从轻或者减轻处罚；有重大立功表现的，可以减轻或者免除处罚。立功必须是犯罪分子本人实施的行为。【法律依据】《刑法》第六十八条犯罪分子有揭发他人犯罪行为，查证属实的，或者提供重要线索，从而得以侦破其他案件等立功表现的，可以从轻或者减轻处罚；有重大立功表现的，可以减轻或者免除处罚。第十四条明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。
