释义	法律分析：卖淫嫖娼是指不特定的同性之间或者异性之间以金钱、财物为媒介发生性关系(不包括按摩服务)(口淫、等)的行为。现行的法律中卖淫不属于犯罪，可根据具体情节予以治安处罚法律依据：《中华人民共和国治安管理处罚法》第六十六条卖淫、嫖娼的，处10日以上15日以下拘留，可以并处5000元以下罚款;情节较轻的，处5日以下拘留或者500元以下罚款。在公共场所拉客招嫖的，处5日以下拘留或者500元以下罚款。
