释义	1998年，制定了基本农田保护条例，于1999年1月1日开始实行，基本农田是按一定时期人口和社会经济发展对农产品的需求，依据土地利用总体规划确定的不得占用的耕地，基本农田是耕地的一部分而且主要是高产优质的那一部分耕地。一般来说，划入基本农田保护区的耕地，都是基本农田。法律依据：《中华人民共和国土地管理法》第八条城市市区的土地属于国家所有。农村和城市郊区的土地，除由法律规定属于国家所有的以外，属于农民集体所有；宅基地和自留地、自留山，属于农民集体所有。
