释义	法律分析: 内退期间由企业发放生活费，在改制前的企业已办理内退手续的，其生活费、养老金从改制后新企业成立的第一天起改按文件执行，由改制后的新企业继续为其发放生活费和缴纳社会保险费;也可以按改制前原内退规定一次性发给有关费用，并缴足有关社会保险费。法律依据: 《劳动部关于严格按照国家规定办理职工退出工作岗位休养问题的通知》一、企业对距退休年龄不到5年的职工，应经本人提出申请，企业领导批准，方可办理退出工作岗位休养。
