释义	法律分析：劳务派遣中发生工伤，应当由劳务派遣公司承担责任。劳务派遣公司和员工的关系是劳动合同关系，是真正的用人单位，工作地的用工单位和员工的关系只是劳务关系(借调关系)，所以员工在工作时间发生意外伤害事故，被认定为工伤的应该由用人单位承担工伤责任。法律依据：《劳务派遣暂行规定》第十条被派遣劳动者在用工单位因工作遭受事故伤害的，劳务派遣单位应当依法申请工伤认定，用工单位应当协助工伤认定的调查核实工作。劳务派遣单位承担工伤保险责任，但可以与用工单位约定补偿办法。
