释义	非法同居是指男女双方未办结婚登记手续即以夫妻名义同居生活，群众也认为是夫妻关系的一种同居行为。非法同居一般是不会被处罚的。当然要看同居的双方的具体情况的，如果一方是已婚并且处于婚姻存续期间而以夫妻名义进行公开同居的话，是要承担法律责任的，即重婚罪。法律依据: 《中华人民共和国民法典》第一千零四十二条禁止有配偶者与他人同居。第一千零七十九条婚或者与他人同居，调解无效的，应当准予离婚。第一千零九十一条因重婚、与他人同居导致离婚的，无过错方有权请求损害赔偿。
