释义	法律分析：一般情况下民事侵权案件不涉及刑事责任问题，需要承担的是民事责任。我国刑法采罪刑法定原则，法无明文规定不为罪。法律依据：《中华人民共和国刑法》第三条法律明文规定为犯罪行为的，依照法律定罪处刑；法律没有明文规定为犯罪行为的，不得定罪处刑。《中华人民共和国民法典》第一千一百六十五条行为人因过错侵害他人民事权益造成损害的，应当承担侵权责任。依照法律规定推定行为人有过错，其不能证明自己没有过错的，应当承担侵权责任。
