释义	法律分析：借款人与担保人签订的免责协议有没有效，要看免责协议是否符合法律规定，如果是故意或者重大过失造成担保人财产损失的，免责协议是无效的。法律依据：《中华人民共和国民法典》第五百零六条合同中的下列免责条款无效： (一)造成对方人身损害的； (二)因故意或者重大过失造成对方财产损失的。第六百八十三条机关法人不得为保证人，但是经国务院批准为使用外国政府或者国际经济组织贷款进行转贷的除外。以公益为目的的非营利法人、非法人组织不得为保证人。
