释义	1、根据《最高人民法院的司法解释》规定，以出轨为理由要求离婚的，如果是与人通奸或同居、且经教育拒不悔改的，才能作为认定夫妻感情确已破裂的依据、可以判决准予离婚。如果出轨为理由请求离婚，收集证据时就必须收集两方面的证据：一是出轨的证据，二是出轨、且经教育拒不悔改，然后写好离婚申请书。2、离婚程序有两种，一种是登记离婚，一种是诉讼离婚。登记离婚需要您与配偶协商好之后，到民政局申请离婚，经民政局审查后批准即离婚。诉讼离婚适用简易程序，您需要向法院递交起诉状，待开庭判决后，即生效。
