房产证分份额和共同共有的区别

释义

法律主观：

房产证共同共有，是指两个以上的所有人对于房屋都享有平等的所有权。共同共有是不确定所有权份额的共有。除依法律规定和当事人另有约定外，对房屋的共有关系不能终止，房屋不能分割，只有出现法律规定或当事人约定的事由，导致产生共同共有的共同关系归于消灭时，共有人才能分割共有房屋。

根据《民法典》第299条规定：共同共有人对共有的不动产或者动产共同享有所有权。
