什么叫作无过错责任 |

法律分析：无过错责任是指依照法律规定不以当事人的主观过错为构成侵权行为的必备要件的归责原则，即不论当事人在主观上有没有过错，都应当承担民事责任。
无过错责任具有以下特征：
(1)以损害事实与责任人的行为之间存在着因果关系为前提，若没有因果关系则不能承担无过错责任;
(2)并不以行为人的主观过错为归责的要件，若以过错为归责的构成要件，那就成了过错责任原则;
(3)无过错责任的宗旨在于合理补偿受害人的损失，这也是许多国家为保障受害人的权益而设立无过错责任原则的原因所在;
(4)由被告就免责事由进行举证，实行举证责任倒置，它不同于过错责任中的“谁主张，谁举证”的举证原则。在适用无过错责任时，原告只要举出损害事实及损害事实和被告的行为之间有因果关系即可，再由被告就存在的法定免责事由进行举证，被告不能仅仅证明他已尽到了注意义务或没有一般的过失就可以被免除责任;
(5)适用无过错责任时必须有法律的特别规定，也就是针对法律明文规定的特殊侵权行为才可适用无过错责任原则。
法律依据：《民法典》第一千一百六十六条行为人造成他人民事权益损害，不论行为人有无过错，法律规定应当承担侵权责任的，依照其规定。
