释义	法律分析：不可以辞退，艾滋病患者在医疗期内,用人单位是不能解聘的。法律依据：《中华人民共和国传染病防治法》第十六条传染病病人、病原携带者和疑似传染病病人，在治愈前或者在排除传染病嫌疑前，不得从事法律、行政法规和国务院卫生行政部门规定禁止从事的易使该传染病扩散的工作。从这条规定来看,艾滋病病毒感染者或病人从事的工作存在传播艾滋病危险的,卫生行政部门通知其所在单位调整其工作岗位,使传播危险消除,也是符合法律规定的。
