释义	我国《民法典》第六百九十四条规定:债权人已提起诉讼或者申请仲裁的，保证期间适用诉讼时效中断的规定。应当说，立法承认保证期间存在中断的情况，而具体内容则适用诉讼时效中断的规定。【法律依据】《民法典》第六百九十四条，一般保证的债权人在保证期间届满前对债务人提起诉讼或者申请仲裁的，从保证人拒绝承担保证责任的权利消灭之日起，开始计算保证债务的诉讼时效。连带责任保证的债权人在保证期间届满前请求保证人承担保证责任的，从债权人请求保证人承担保证责任之日起，开始计算保证债务的诉讼时效。
