释义	法律分析：一审判决没有当事人在上诉期内上诉的才生效，二审判决只要做出就生效。所以，无论是否有新的证据，二审判决都是终审的判决。因此，在离婚诉讼中，只要进入二审程序，二审判决便为最终判决，不能再提出上诉法律依据：《中华人民共和国民事诉讼法》第十条人民法院审理民事案件，依照法律规定实行合议、回避、公开审判和两审终审制度。
