法律分析：
“胎”的含义，指的是人或其他哺乳动物怀于母体内的幼体。一胎和二胎的关系，就在于该母体怀孕或生育的次数。“二孩”，指的是第二个孩子，是生育子女的个数。二孩，即为该夫妻生育的第二个子女。在日常生活中，习惯性地对育龄妇女第一次怀孕后生育的，被称为生育了第一胎；第二次怀孕生育的，就成了第二胎。在现行计划生育法律法规中，精确地直接指向是“第一孩”、“第二孩”，而不称为“第一胎”、“第二胎”，其原因就在于一胎生下的不仅仅是一个孩子，也有可能生育出两个或三个甚至更多的孩子。因此，联系到目前实施的“一对夫妻可生育两个孩子”的新政策，准确地说，这叫“两孩政策”而并非“两胎政策”。
法律依据：
《全面二胎》 有下列情形之一的，由夫妻双方共同申请，经乡镇、街道卫生和计划生育工作机构或者县级以上直属农林场审批，可再生育：
（一）因子女死亡无子女的，可再生育两个子女； （二）因子女死亡只有一个子女的，可再生育一胎子女； （三）其他符合法律、法规规定再生育条件的情形。
