释义	员工与单位的劳动关系存续期间，单位没有给员工缴交社保的，员工可以要求单位补缴。在职员工可以与单位协商，离职员工需在离职后一年内与单位协商，要求补缴，协商不成的，可以向属地劳动监察申请劳动仲裁，主张单位补缴社保。法律依据：《社会保险费申报缴纳管理规定》第八条用人单位应当自用工之日起30日内为其职工申请办理社会保险登记并申报缴纳社会保险费。未办理社会保险登记的,由社会保险经办机构核定其应当缴纳的社会保险费。
