释义	法律分析: 身体有病或者生活不能自理的不能拘留。法律依据: 《拘留所条例实施办法》第十九条收拘时或者收拘后，拘留所发现被拘留人有下列情形之一的，应当出具建议停止执行拘留通知书，建议拘留决定机关作出停止执行拘留的决定：（一）患有精神病或者患有传染病需要隔离治疗的；（二）病情严重可能危及生命安全的；（三）生活不能自理的；（四）因病出所治疗，短期内无法治愈的。拘留决定机关应当立即作出是否停止执行拘留的决定并通知拘留所。
