释义	法律分析：无效的。劳动合同一式两份，用人单位和劳动者各执一份。劳动者和用人单位签订了书面劳动合同，用人单位未给劳动者一份，属于违法行为，劳动者可以要求用人单位给自己一份，否则可以向劳动监察投诉。用人单位未给劳动者一份劳动合同，给劳动者造成损害的，应当承担赔偿责任。法律依据：《中华人民共和国劳动合同法》第十六条劳动合同由用人单位与劳动者协商一致，并经用人单位与劳动者在劳动合同文本上签字或者盖章生效。劳动合同文本由用人单位和劳动者各执一份。
