法律主观：
1、用人单位不得违反 劳动法 规定延长劳动者的工作时间。平时 加班 必须支付 加班工资 ，不能用调休来补偿。休息日的加班可以用补休的办法来补偿。平时加班为平时 工资 的1.5倍，休息日为两倍。因特殊原因需要延长工作时间的，在保障劳动者身体健康的条件下延长工作时间每日不得超过三小时，但是每月不得超过三十六小时。 2、双休日加班后，是安排补休还是支付 加班费 ，决定权在企业，职工没有选择权。根据有关法律 法规 的规定，只有平时晚上的加班和国定假日的加班，用人单位必须支付加班工资。
