释义	法律分析：自从2008年《劳动合同法》、《劳动争议调解仲裁法》施行以后，对于劳动者的兼职行为，司法审判机关根据相关规定，基本持肯定态度。只要劳动者与兼职单位建立的用工关系符合劳动法的规定，原用人单位和兼职单位对劳动者的兼职行为没有异议，一般都认定劳动者与兼职单位之间也存在劳动关系，受劳动法的保护，以符合劳动法所倡导的“维护劳动者合法权益”的立法精神。法律依据：《中华人民共和国劳动合同法》第七条用人单位自用工之日起即与劳动者建立劳动关系。用人单位应当建立职工名册备查。
